In principle, there are always two methods to have a child's parenthood acknowledged. Nevertheless, due to the legal framework in Germany, the acknowledgment of the intended father is generally less complicated than that of the mother.
Under German law, a German father can be recognized as such if the woman who has given birth to the child is unmarried. This is not an option for the intended mother because, according to German law, the woman who has given birth is always considered the child's mother. The BGH has determined that a woman cannot register as the mother of a child born to a Ukrainian surrogate based on a Ukrainian birth certificate.
