Recognizing Parenthood in Germany

In principle, there are always two methods to have a child's parenthood acknowledged. Nevertheless, due to the legal framework in Germany, the acknowledgment of the intended father is generally less complicated than that of the mother.

Under German law, a German father can be recognized as such if the woman who has given birth to the child is unmarried. This is not an option for the intended mother because, according to German law, the woman who has given birth is always considered the child's mother. The BGH has determined that a woman cannot register as the mother of a child born to a Ukrainian surrogate based on a Ukrainian birth certificate. This ruling holds true regardless of any biological connection, as seen in cases of surrogacy or gestational surrogacy. If the intended father is acknowledged as the father, the only remaining avenue for the intended mother is to pursue stepchild adoption under German law.

The alternative is to recognize a Ukrainian court ruling that identifies the parents. Such a ruling can subsequently be acknowledged in Germany in accordance with § 107 FamFG. If this is feasible, it can help avoid the protracted adoption process. A birth certificate does not constitute a decision under § 107 FamFG and, as such, is not eligible for this type of recognition. Nevertheless, our legal team in Ukraine will file a motion with the Ukrainian court to acknowledge the intended mother as the mother of the surrogate child. This legal process may take up to five months following the birth of the child. After receiving the decision from the Ukrainian court, your German law firm will present this decision to seek parental recognition in Germany.

Entry Clearance into Germany and German Citizenship After Surrogacy

If the intended father is acknowledged as the legal father from the beginning, he has the opportunity to request documents from the German Embassy in Ukraine that will allow him to enter the country with the child. The same is true if a ruling has been made recognizing both intended parents as legal parents.

Even while they do not always stop fertilisation, problems with chromatin packing, oxidative stress, sperm DNA breakage, and modest chromosomal abnormalities frequently affect later stages of embryonic development.

Fertilised eggs containing sperm with a higher rate of DNA fragmentation have a greater likelihood of an embryo ending development at the early cleavage stage or never reaching the blastocyst stage. This has been demonstrated by research. There is a limit to how much donor eggs can make up for minor sperm flaws during the first few cell divisions. As the embryo begins to rely on its own genome, sperm-related genetic instability frequently becomes noticeable. Donor egg surrogacy programs must therefore require comprehensive sperm evaluations and, if necessary, improved laboratory techniques or sperm selection.

In human embryology, the 3rd day marks a significant biological milestone. Thus far, the amount of maternal RNA, proteins, and energy stores in the egg has supported the growth of the embryo. An event known as embryonic genome activation takes place around day three. In this stage, the embryo must start expressing its own genetic instructions.

The embryo may stop developing at this stage if there are chromosomal abnormalities, mistakes in DNA repair, or an imbalance between the maternal and paternal genetic material. The occurrence of this incident is not unusual and does not point to errors in the laboratory or violations of clinical standards. This phenomena is better explained as a manifestation of natural selection, which prevents embryos without adequate genetic competence from continuing to develop. One important and well-documented aspect of human reproduction is day three arrest. Even in cycles that use young women’s donor eggs, it happens.

The quality of the embryo is determined by complex interactions between the egg, sperm, and the laboratory environment. Although the age of the donor egg significantly reduces the likelihood of chromosomal problems, the egg still controls the quality of the embryo. Although a young egg can enhance chromosomal integrity, mitochondrial function, and the accuracy of cellular division, it cannot compensate for defective sperm DNA or harsh laboratory conditions.

The method of fertilisation, the culture media, the incubation systems, and the embryologist’s skill can all have an impact on the development’s outcomes. Therefore, it is more realistic to think of embryo quality as an outcome influenced by multiple factors rather than as a result determined by a single ingredient. The optimal conditions for donor egg surrogacy are not just when the eggs are old, but also when all the biological and technological aspects are in balance.

Despite the fact that outcomes differ from patient to patient and clinic to clinic, consolidated clinical data provide more reasonable expectations. Eleven to thirteen out of fifteen mature donor eggs will normally fertilise successfully. Approximately six to eight of these embryos may continue to divide until the third day. Three or five of the embryos may develop into blastocysts on day five or six of embryonic development.

The reason for this is that certain programs can induce pregnancy after only one or two transfers, while others would require a third try. Remember that an unsuccessful transfer does not necessarily mean that the surrogate is having problems or that the embryos are of poor quality. Instead of rating fertility results based on a single cycle, it is more appropriate to analyse them cumulatively across all transfers.

In medical institutions, blastocyst stage culture can be used to identify embryos that have demonstrated consistent developmental ability. By day five or six, the embryo has successfully activated its genome and coordinated cell differentiation.

Blastocyst transfer is linked to both increased implantation rates and improved synchronisation with the prenatal environment. Careful planning and a small number of embryo transfers are characteristics of successful surrogacy; blastocyst selection is a stronger indicator of this than earlier-stage embryo transfers.

By identifying embryos with aberrant chromosome counts, pre-implantation genetic testing for aneuploidy (PGT-A) can reduce the likelihood that the embryos will fail to implant or miscarry. Even though using donor eggs significantly lowers the risk of aneuploidy, chromosomal abnormalities may still occur as a result of sperm factors or post-fertilization events.

The PGT-A is not so much a guarantee as a screening tool. It’s crucial to keep in mind that genetic testing does not eliminate all dangers, and many healthy pregnancies can still occur without it.
